Any dispute arising out of or relating to these Terms or the Site shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, conducted in Ashland, Ohio or by telephone or videoconference at your election. The parties waive any right to a jury trial and to participate in a class, collective, consolidated, or representative action. Notwithstanding the foregoing, in accordance with the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act of 2021, you may elect to bring any claim alleging conduct constituting a sexual assault dispute or sexual harassment dispute in court rather than in arbitration. The Company may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property.
